Specialisations and Interests

Johan advises retirement funds, employers, unions, insurers, administrators and other service providers on a wide range of legal issues concerning occupational retirement.  Drafting of opinions on a range of employee benefit issues including issues relating to pre-funding of employer liabilities in respect of post -retirement medical aid, constitutional issues, duties and powers of trustees and employment-related issues.  He also has extensive experience in pension law, commercial and constitutional litigation in the context of commercial transaction and in relation to employee benefits and has a wide range of experience in insolvency, forensic and regulatory work.  He acts as mediator and arbitrator in various financial services related matters.  Is a liquidator of various retirement funds appointed by the Financial Services Conduct Authority (‘FSCA’).  Johan is also a co-author of Hunter Law’s textbook The Pension Funds Act:  A Commentary.

Special interests and expertise:

  • All aspects of litigation with a focus on regulatory work including the representation of clients before the pension funds adjudicator, the appeal board and the enforcement committee established in terms of the Financial Services Board Act, the high court, the supreme court of appeal and constitutional court;
  • Research and writing detailed legal opinions on all aspects of regulatory and employee benefits law; and
  • Training principal officers and members of fund boards of management.
